Bylaws for Ditch Companies

The Ditch and Reservoir Company Alliance (DARCA) will be hosting a Bylaws for Ditch Companies workshop, on Friday, October 22 from 1:00 to 5:30 p.m. at the Denver Water Administration Building, 1600 West 12 Ave. in Denver , Colorado.
The Bylaws Workshop will be interactive and will focus on improving and modernizing ditch company bylaws. Issues will be considered from the perspectives of both the individual shareholder and ditch companies. The workshop instructors will provide a wealth of information on a broad array of issues relevant to shareholders, directors and officers serving on ditch and reservoir companies, and water attorneys.   Topics will include: the history and development of ditch company by-laws; articles of incorporation, bylaws and ditch company rules; and restrictions on shareholders’ right to transfer shares and to lease rights to water, including discussion of “Caitlin” bylaw provisions. Sample bylaws will be available to the participants.
The instructors for the course are Eve Triffo and John McKenzie, both DARCA board members. Eve, a retired lawyer, is also a shareholder in the Cañon City and Oil Creek Ditch Company. John, the Executive Director of DARCA has extensive experience in mutual ditch companies and non-profit organizations.
The Ditch & Reservoir Company Alliance, a nonprofit organization, established in 2001, is dedicated to serving the needs of mutual ditch and reservoir companies, irrigation districts and lateral companies.
The price of the workshop is $50 for DARCA and Colorado Water Congress members and $100 for non-members. The course is expected to be accredited for 5 general credits of Continuing Legal Education (CLE).
